Extendly, LLC (“Extendly” or “we”) is committed to providing the Extendly Software as a Service Application (the “Service”) in a manner that is fair, equitable, and accessible to all our users (“Users” or “you”). This Fair Use Policy (the “Policy”) is established to ensure that our Service remains high-quality, reliable, and available to everyone without unfair consumption or usage practices by a minority impacting the majority.

This Policy outlines the acceptable use of Extendly’s Service, defining the boundaries of “fair use” to prevent abuse that could negatively affect the service quality for other Users. It applies to all Users of the Service and is designed to guarantee that the Service’s quality, availability, stability, uniformity, and performance are maintained at all times.

1. Usage Limits: We have established usage limits that are considered fair and sufficient for typical use based on historical data and user needs. These limits are designed to ensure that over 95% of our Users can use the Service without any restrictions.

2. Monitoring: Extendly actively monitors usage to identify excessive use patterns that may signify unfair use of resources.

3. Consequences of Excessive Use: Users whose usage significantly exceeds the established fair use limits may experience:

1. Throttling or limitation of Service access, potentially without warning, to mitigate impact on other Users.

2. The possibility of facing additional charges or being required to upgrade to a plan that more accurately reflects their usage patterns.

  • Initial Assessment: If usage that exceeds the fair use limits is detected, Extendly may first contact the User to discuss their usage patterns and potential steps to mitigate excessive use.

  • Warnings: Users consistently exceeding fair use limits may receive warnings and have their access to the Service limited or throttled.
